McKinney-Vento Homeless Education
Part of the No Child Left Behind federal legislation, the McKinney-Vento Homeless Education Act protects eligible students fromdiscrimination and mandates equal access to educational programs and services. Students who are identified as McKinney-Vento eligiblemust have no barriers to their education.A student is considered“McKinney-Vento eligible” ifhe or she is presently:McKinney-Vento studentshave the rights to:
• Living in a shelter• Living in a motel, hotel orcampground due to lack ofadequate housing• Sharing housing with relativesof others due to a lack ofhousing• Living at a train or bus station,a park, or in a car• Living in an abandoned building• A youth not living with aparent or guardian• A child awaiting foster careplacement• A child of a migrant worker• In other situations that arenot fixed, regular, or adequatefor night time residence• Immediate school enrollment:even if they lack proof of residency,guardianship, immunizations, orschool records.• School Choice: Students maychoose to stay at the school attendedwhen permanently housed orto enroll in the school wherecurrently living for the remainderof the academic year.• Free Lunches: McKinney-Ventostudents are automatically eligible toreceive free lunch for the duration ofthe school year.• School fee waivers: Students havethe right to equal access toeducation.• Transportation: While students arein unstable housing, transportation isprovided for students residing outsideof their school’s attendance area..
